PlusCash – Terms & Conditions

Huex Private Limited, operating under the brand name PlusCash (hereinafter referred to as “PlusCash”/ “Us”/ “We”/ “Our”), offers facilities to enable Registered Users to carry out transactions in units of different mutual fund schemes. PlusCash holds a valid registration with the Association of Mutual Funds in India (“AMFI”) under ARN No. 275498 and is authorized to act as a distributor of mutual funds.

Your use of the services made available by PlusCash as a Registered User and/or an Investor shall be governed by these PlusCash Terms and Conditions (“Terms”).

When you voluntarily provide any of your personal information requesting to avail a service or Services from PlusCash, you become a Registered User and customer of PlusCash (“Registered User”/“you”/ “your”). You acknowledge that you have read, understood, and agreed to these Terms as well as the Privacy Policy. We urge you not to proceed with the usage of the Services if you do not agree to either the Terms or the Privacy Policy.

These Terms constitute a computer-generated electronic record published in terms of the Information Technology (Intermediaries Guidelines) Rules, 2011 read with the Information Technology Act, 2000 and does not require any digital signatures.

As a Registered User, you shall be entitled to inter alia avail facilities of purchasing, redeeming, and switching of mutual fund Units (“Transaction/(s)”) of Schemes of Asset Management Companies (“AMCs”) with which PlusCash has arrangements to act as a distributor (hereinafter referred collectively as “Services”). “Unit” shall mean the interest of an investor, which consists of one undivided share in the Net Assets of the Scheme.

BY PROCEEDING WITH THE USE OF THE SERVICES, YOU AGREE AS FOLLOWS:

1. Eligibility

By proceeding to avail the Services, you represent to PlusCash that you are competent to contract within the meaning of the Contract Act, 1872 and at least 18 (eighteen) years of age. You also understand that the Services can currently only be availed by Indian citizens and tax residents of India.

2. General Terms and Your Authorizations to Us

  • Your access to the Services will be activated after PlusCash verifies your personal information in accordance with the Know Your Client (“KYC”) guidelines issued by the Securities and Exchange Board of India (“SEBI”) from time to time.
  • If you are a first-time investor and are purchasing Schemes for the first time, you agree to provide PlusCash all documents requested for by the AMC for the purpose of completing the KYC and Anti-Money Laundering compliance process in accordance with applicable law.
  • You authorize PlusCash to utilize your KYC information including identity documents such as PAN and Aadhaar, and to share such information with the AMCs / PlusCash affiliates or its platform for validation, service delivery, or to comply with regulatory requirements.
  • You agree and understand that the Services provided herein are presently available only in respect of limited mutual fund schemes managed by AMCs with which PlusCash has entered into specific legally binding arrangements.
  • You also agree and understand that the Transactions done by you will be tagged with PlusCash’s ARN No. 275498 and shall not be an investment under the Direct Plan.
  • By proceeding to invest, you hereby irrevocably grant to PlusCash, its affiliates, and the associated AMCs your consent to collate transaction details and transmit such data to the concerned AMC or Registrar and Transfer Agent (“RTA”) for further processing.
  • You acknowledge that failure to provide requested information may result in your ineligibility to avail of some or all of the Services.
  • You agree that execution of Transactions is subject to the respective Scheme Information Document (“SID”) and addendums issued by the AMC. You acknowledge having read such documents before proceeding with transactions.

3. Terms for Credit

HUEX PRIVATE LIMITED is the legal entity and Apple Developer Program account holder. PlusCash is a brand owned and operated by HUEX PRIVATE LIMITED.

We are not a lending entity. The “Get Credit” option only redirects users to Mirae Asset Financial Services via their official link. All loan processing, approval, and servicing is handled solely by Mirae Asset, a licensed NBFC.

HUEX PRIVATE LIMITED is an authorized Direct Selling Agent (DSA) partner of Mirae Asset. Please find attached the partnership agreement as documentary evidence. In the provided document, you can see HUEX PRIVATE LIMITED on the top right corner of the pages with our ARN and PAN. The agreement contains complete details of the partnership.

4. Collection and Use of Your Information

  • You agree and consent to PlusCash, directly or through its affiliates, collecting, using, and storing your personal information for the purpose of delivering the Services and complying with applicable law.
  • PlusCash may also contact you for all purposes connected with Services including for marketing and promotion of other PlusCash offerings via email, SMS, voice calls, push notifications, or other permitted channels.
  • Your data may be shared with AMCs, RTAs, or authorized third parties only for the purposes of validation, legal compliance, and service fulfillment.

5. Terms Regarding Transaction Processing

  • Transactions will be processed on the same day if received before the cut-off time(s) specified by PlusCash; else, they will be processed the next business day.
  • SIP transactions will be debited on scheduled dates on a best-effort basis, and NAV will be applied as per SEBI’s applicable cut-off timing rules.
  • PlusCash shall not be liable for any incorrect NAV allocation, delays due to insufficient balance, system downtime, or failures at the AMC’s end.
  • All authorized and complete transactions once processed cannot be canceled.
  • PlusCash may, in its discretion, refuse to transmit your Transaction data if instructions are incomplete or unverifiable.

6. Your Covenants and Declarations

You declare that:

  • The funds invested are from legitimate sources, not intended for money laundering or illegal purposes.
  • Documents submitted by you are true and not tampered with.
  • You understand that mutual fund investments are subject to market risks and have read all relevant Scheme documents.
  • You agree to indemnify PlusCash, the AMCs, and their trustees against losses arising from fraudulent or improper transactions initiated by you.

7. PlusCash Covenants and Declarations

  • PlusCash, as an AMFI-registered distributor, strictly adheres to the AMFI Code of Conduct.
  • PlusCash receives commissions from AMCs for distribution. The rates (exclusive of GST) may be disclosed on request.
  • Mutual fund schemes offered are not recommended or advised by PlusCash. Transactions are execution-only.
  • PlusCash does not charge advisory fees, nor does it deduct any transaction charges from investments.

8. Limitations and Disclaimers

  • PlusCash shall not be liable for delays or failures by AMCs, RTAs, or payment systems.
  • Services are provided on an “as is” basis without warranties of accuracy, continuity, or fitness for purpose.
  • You are solely responsible for determining suitability of investments.
  • PlusCash is not liable for market losses, tax consequences, or investment performance.

9. Scheme Related Risks

Mutual fund investments are subject to market risks, including fluctuations in NAV. There can be no assurance that a scheme’s investment objectives will be met. Please read all Scheme-related documents carefully before investing.

10. Use Terms and Intellectual Property

All intellectual property including trademarks, logos, technology, and algorithms of PlusCash remain its exclusive property. You are not authorized to use them without prior written approval.

11. Termination

You may transfer your investments to another distributor by writing to the AMC. PlusCash may terminate Services with prior notice of 30 days.

12. Modification of Terms

PlusCash may update these Terms from time to time. Continued use of Services constitutes acceptance of modified terms.

13. Grievance Redressal and Support

  • In case of issues, you may escalate by contacting contact@pluscash.club or by using our dedicated support portal.
  • Response will be provided within 24-48 hours and resolution within 3 business days, subject to AMC dependencies.

14. Governing Law

These Terms shall be governed by the laws of India, and courts in Bengaluru, Karnataka shall have exclusive jurisdiction over all matters connected with the Services.
